Did you know that Florida is one of three states that allow notaries to perform marriage ceremonies? Florida Statute 741.07 authorized notaries public in the state of Florida to solemnize the rights of matrimonial contract, under the regulations prescribed by law. The wedding ceremony must take place in Florida and the couple must obtain a valid marriage license prior to the ceremony. The law also allows for notaries to perform marriage ceremonies for family members because the notary is not notarizing anyone's signature on the license. The notary is merely certifying on the license that they have performed the ceremony. did you know FL notaries can officiate weddings On the wedding day, the notary should obtain the marriage license from the couple prior to the ceremony, to verify the document is valid. A notary should always check the effective and expiration dates and also check to see if it contains the Clerk's signature and official seal. After the ceremony has taken place, the notary must complete the appropriate section certifying they have joined the couple in marriage. As the performing official, the notary must return the marriage license to the Clerk's Office that issued the license within 10 days after the ceremony. The Clerk will record the license and send a certified copy to the newlyweds. *Update: As of January 2015, the state of Florida now allows same-sex marriages. Notaries public may also officiate at these ceremonies. The procedure would be the same all marriages.
