Montana New law Montana’s Senate Bill 306 was signed by the Governor yesterday, May 5, 2015, and will go into effect October 1, 2015. The bill changes a lot of the regulations for Montana notaries. Here is a rough outline of the major changes, but please read the bill for a full understanding.
  1. Allows electronic notarization.
  1. Exam for qualification for new notaries (section 16 point 2 and section 17). Although an examination for new notaries has been required since 2010, Montana has written new sections in the law about the examination requirement.
Section 15 pertains to the standards of the Montana notary journal:
  1. Allows for multiple journals.
  2. Further describes what needs to be included in a notary’s journal, as well as the maintenance and upkeep of notary journals.
  3. Allows electronic journals.
  1. Allows the use of an ink stamp or an embosser as the official notary seal (section 2 point 8). Previously, only the ink stamp was allowed as your official notary seal, now Montana has allowed you to emboss your seal as well.
